Terms of Service

1. The agreement

These Terms of Service ("Terms") govern your use of the FisherGuy iOS application and the website at fisherguy.app (collectively the "Service"), operated by [OPERATOR ENTITY — TBD], [reg. no. TBD], [HQ — TBD] ("we", "us").

By creating an account or using the Service, you agree to these Terms.

2. End User License Agreement (EULA)

The FisherGuy iOS app is licensed (not sold) to you under Apple's Standard End User License Agreement (Apple EULA), which forms part of these Terms. Where the Apple EULA and these Terms conflict, the more user-favorable provision applies.

3. Eligibility

You must be at least 13 years old to create an account. Users under 18 in some jurisdictions need a parent or guardian to agree on their behalf.

4. Your account

You are responsible for keeping your sign-in credentials confidential. Notify us immediately of any unauthorized account activity. You may delete your account at any time via Profile → Delete Account; deletion is permanent and erases all your catches, photos, and personal data within 30 days (excluding limited records we must keep under tax / accounting law).

5. Acceptable use

You agree not to:

Use the Service to violate any applicable law (including fishing regulations and license requirements in your jurisdiction)
Harass, threaten, or impersonate other users
Upload illegal, sexual, violent, or otherwise objectionable content
Attempt to reverse-engineer, decompile, or break the Service's security
Use automated systems to scrape, harvest, or extract data
Resell or sublicense the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these rules.

6. User content

You retain ownership of your catches, photos, and other content ("Your Content"). By posting Your Content on community surfaces (feed, public spots), you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute it solely to operate the Service. You can revoke this licence at any time by deleting the content.

You represent that Your Content does not infringe third-party rights.

7. Subscriptions and refunds

FisherGuy is currently free during beta. Future subscriptions ("Pro") are billed by Apple through the App Store. Subscriptions renew automatically; you can cancel at any time in iOS Settings → Apple ID → Subscriptions.

Refunds are governed by Apple's policy. Statutory rights under EU consumer law (e.g. 14-day right of withdrawal where applicable) are not affected. To request a refund: reportaproblem.apple.com.

8. AI suggestions are not advice

The AI in FisherGuy provides informational suggestions about fishing spots. We do not guarantee fish will be at any location, that conditions will be safe, or that you have the legal right to fish there. Always verify local fishing licenses, water-access rules, weather, and ice safety before fishing. Use FisherGuy at your own risk.

9. No warranty

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation, except as required by applicable law.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim (or €50, whichever is greater). We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability that cannot be limited by law (such as for gross negligence, willful misconduct, or statutory consumer rights).

11. Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms.

12. Changes to the Service

We may modify, suspend, or discontinue features at any time. For major changes affecting paid subscribers, we will give 30 days' notice by email.

13. Changes to these Terms

We may update these Terms; the "last updated" date at the top reflects the latest revision. We will notify you by email and inside the app of material changes affecting your rights.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms. Sections 6 (your content), 8 (AI disclaimer), 10 (liability), 15 (governing law), and 16 (disputes) survive termination.

15. Governing law

These Terms are governed by the laws of [JURISDICTION — TBD], excluding its conflict-of-law rules. Consumer-protection rules of your country of residence apply where they cannot be waived by contract.

16. Disputes

Disputes will be resolved before the courts of [HQ — TBD], unless mandatory consumer-protection law in your country requires a different forum. EU consumers may use the Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
